Advertising materials are acceptable as trademark specimens for services (classes 35-45) but not goods (classes 1-34). For goods, your trademark specimen has to prove the products have entered US commerce, and promotional material can't prove that your goods are actually available in the marketplace.

For goods, the most appropriate specimens include a picture of the product, packaging, or a label attached to the product bearing the mark.

You can find examples of acceptable and unacceptable specimens for your niche in our Specimen guide.
