Do I need to get a trademark in China if I export my products from there?

It is highly recommended to get a trademark in China, even if you are only importing your products from there. The Supreme Court of China recently came to the decision that goods manufactured in China and exported to other countries might, under some circumstances, constitute an infringement of IP rights.

It is necessary to consider:

  • whether customers in China might access these products online, and
  • whether this might confuse other people in relevant trade (for example, in logistics).

Even though this doesn't have to mean that you will be causing infringement and infringement proceedings will occur, the chances are relatively high, and we recommend preventing such an outcome.
